The court is in receipt of defendants’ motion for leave to file a late response in opposition to plaintiffs’ motion for leave to file second amended complaint. (Dkt. # 84 .) While defendants’ filing skirts the “excusable neglect” standard under Rule 6(b)(1), the lack of prejudice to plaintiffs in granting defendants’ motion — especially when viewed in light of the timing of plaintiffs’ own motion for leave to amend their complaint — weighs in favor of defendants’ requested four-day extension. See Commodity Futures Trading Comm’n v. Lake Shore Asset Mgmt. Ltd., 646 F.3d 401, 405 (7th Cir. 2011) (“The stronger the excuse and the graver the adverse consequences of rejecting it relative to the adverse consequences to the opposing party if the excuse is allowed, the more the balance leans toward granting.”). The court also notes that this is an unusual mistake for the government’s counsel to make. Were that to change, the court is unlikely to be as lenient. Moreover, the court will extend the deadline for plaintiffs’ reply in support of their motion for leave to amend to ameliorate any prejudice to plaintiffs. Accordingly, defendants’ motion for leave to file a late response (dkt. # 84 ) is GRANTED. Plaintiffs’ reply in support of their motion for leave to amend is now due June 15, 2018. At the end of its opinion and order on the parties’ respective motions for summary judgment, the court alluded to the availability of punitive damages under Title VII. In doing so, the court failed to note, as it had previously, that plaintiffs withdrew a claim to punitive damages under Title VII in response to an earlier motion to dismiss. (See Pls.’ Br. (dkt. # 39 ) 23 n.11 (“Plaintiffs also agree that the punitive damages claims under Title VII against the State Defendants (Defs.’ Br. at 22) may be dismissed.”); 5/11/18 Op. & Order (dkt. # 67 ) 4 (acknowledging plaintiffs’ withdrawal of claim).) Accordingly, no question of punitive damages will be submitted to the jury. The court thought it might be helpful to clarify this in advance of the final pretrial conference next Tuesday.
