04/25/2019 7 ORDER: Plaintiff has filed a Motion for Leave to Proceed in Forma Pauperis (“IFP”) in this case (see Doc. 4 ), but has failed to provide the necessary prisoner trust fund account information as required by the PLRA to determine whether the inmate is entitled to proceed without prepaying fees and costs. Pursuant to 28 U.S.C. Section 1915(b)(1), the Court must review the prisoner trust fund account statement for the 6 month period immediately preceding the filing of this action. IT IS THEREFORE ORDERED that Plaintiff shall provide the Clerk of Court with the attached certification completed by the Trust Fund Officer at the facility and a copy of his/her trust fund account statement (or institutional equivalent) for the period 10/1/2018 to 4/12/2019 no later than 45 days from the date of this order. Failure to do so will result in dismissal of this action for failure to comply with an Order of this Court. Fed. R. Civ. P. 41(b). See generally Ladien v. Defendant continues noting that “[i]n particular, Plaintiff claims in her declaration in support of her reply brief that Dr. Langham informed Plaintiff ‘that Dr. Stahl had considered and deferred my request for gender-affirming surgery and permanent hair removal.'” (Id. at p. 2). This is not a new argument. In Plaintiff’s Motion for Expedited Discovery, Plaintiff notes “[t]hese records include significant materials relating to Defendants’ discussions regarding (and apparent denials of) gender-affirming healthcare for Ms. Iglesias, as well as recent communications between Ms. Iglesias’s current healthcare providers and Federal Bureau of Prisons administrators.” (Doc. 146 , p. 2). However, Plaintiff’s argument on reply is more specific and includes details that Defendants did not have an opportunity to appropriately respond to. 10/22/2021 163 ORDER: Defendants have proposed a deadline to comply with the Court’s order on expedited discovery by November 22, 2021. In support of this proposed expedited discovery deadline, Defendants note that “an average processing rate (i.e., review and redaction) of twenty-five documents per hour and eight-hour review days, it will take twenty-six full days to review the approximately 5,200 collected documents, absent further narrowing.” (Doc. 161 ). The Court does not have an issue with the estimated time of twenty-five documents per hour. However, Defendants’ estimate is based on one attorney doing this work. Defendants have five attorneys entered in on this case. Thus, even if it just these five attorneys reviewing the estimated 5,200 documents for four hours a day it should take less than 11 days. While the Court appreciates Defendants’ proposed deadline, a November 22nd deadline is unreasonable based on the necessity of these documents.
