For the reasons discussed during the hearing on May 11, 2020, the court orders the following: Federal Defendants shall produce the governing foster care cooperative agreements, grant applications, and any communications regarding the interpretation and implementation of the religious belief clauses in such agreements between Federal Defendants and the U.S. Conference of Catholic Bishops (USCCB), inclusive of the initial grant application period in which USCCB participated as a grantee in the UAC program, and from June 26, 2013, to the present. However, on the basis of Federal Defendants’ representations that they are unaware of any other instance in which a USCCB grantee or subgrantee has had religious objections (whether based on sexual orientation or any other religious belief) to placing a child with foster parents, the court denies Plaintiffs’ broader request for nationwide discovery pertaining to instances of religious discrimination against foster parent applicants by USCCB or its subgrantees. The court will revisit its ruling should Plaintiffs provide concrete evidence that USCCB or its subgrantees engaged in religious discrimination against foster parents, and that Federal Defendants were likely aware of such discrimination.
